Lewis W. Fishman

Mr. Fishman has been a member in good standing of the Florida Bar since 1976, and of the District of Columbia Bar since 1978. He is Board Certified in Health Law by the Florida Bar in accord with the Certification Program authorized by the Florida Supreme Court. Mr. Fishman has maintained an AV rating by Martindale-Hubbell continuously since becoming so eligible.

Mr. Fishman’s practice had been devoted exclusively to the practice of health and hospital law and medical jurisprudence, licensure, corporate law and business transactions. He represents a broad range of clients, including hospitals, profit, non-profit and public, as both general and special counsel; physicians, either individually or as part of small practices, as well as large single and multi-specialty group practices; professional liability insurance insurers to physicians; assisted living facilities; nursing homes; home health agencies; hospices; freestanding diagnostic centers, ambulatory surgery centers, and a myriad of other health care providers.

Mr. Fishman provides advice in substantive areas of law and practice including general corporate and business advice, for profit and not-for-profit; as well as specific health care related advice, including advice on Stark and Anti-kickback matters; physician self-referral, fee-splitting, general Federal and state health laws, Medicare and Medicaid regulations, hospital and physician operational issues, clinical trials and IRB, bioethics, patient’s rights and informed consent laws, HIPAA, medical staff issues, false claims and qui tam actions, the drafting and negotiation of contracts, including vendor and managed care agreements; the drafting of governance documents, including articles of incorporation and bylaws; all regulatory and licensure filings; negotiation of business transactions; issues related to non-profit tax-exempt status; and labor matters.

Mr. Fishman provides counsel on insurance matters; billing and collection issues; regulatory compliance; licensure matters; business transactions; corporate formation; vendor leasing; and in the drafting and negotiation of employment, independent contractor, and third party payor contracts.

Mr. Fishman was instrumental in the formation of the Health Law Section of the Florida Bar, which currently has in excess of 1500 members; served on its Health Law Executive Council for over ten years, including a term as Chair; was one of nine statewide attorneys appointed to serve on the inaugural Health Law Certification Committee of the Florida Bar, with responsibility for writing and grading the examination, including two terms as its Chair; served six years on the Board of Legal Specialization and Education of the Florida Bar, which is the body charged with oversight of the entire certification program of the Florida Bar, including serving two terms as Chair of its Standards Committee; and served six years as a member of the Florida Bar’s Professional Ethics Committee. He has also served on the Board of Directors of the Florida Academy of Healthcare Attorneys for over twenty years, including terms as its Secretary, Vice President, and President.

Mr. Fishman is a former adjunct instructor in the Records Administration Program of Florida International University, and has lectured extensively on health law matters on a local, state, and national basis.
